2. Providing this website

This website is hosted by Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA. When you visit it, the server processes technically necessary data (IP address, date and time, the address requested, browser identification) in order to deliver the page and protect it against misuse. The legal basis is Art. 6(1)(f) GDPR.

Vercel retains these logs for one day on the plan we use and deletes them automatically afterwards.

For the basis of the transfer to the USA, see section 6. On your first visit we forward you automatically to the German or the English version. To do so we evaluate your browser’s language setting and the country that Vercel derives from your IP address. The country is used for this decision only and is not stored. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest is to show you the site in your language.

3. Contact by email or telephone

When you contact us, we process your details in order to handle your enquiry and any follow-up questions. The legal basis is Art. 6(1)(b) GDPR where the enquiry relates to a contract, otherwise Art. 6(1)(f) GDPR.

4. Enquiry forms

On this website you can request pricing, samples, the catalogue, certificates or a consultation. Depending on the form, we process:

  • Required details: company, country, name and email address — without them we cannot answer your enquiry.
  • Optional details: telephone number, your message, the moss types and quantities you are interested in, one-off or recurring order with delivery interval, the evidence you need, a preferred appointment with time and time zone, and a time for a call back.
  • The page you sent the enquiry from, plus the date and time it arrived.

The legal basis is Art. 6(1)(b) GDPR, because your enquiry is aimed at entering into a contract; where that does not apply in an individual case, Art. 6(1)(f) GDPR, with our legitimate interest in answering enquiries. You are not obliged to provide any of these details.

To fend off automated bulk submissions, every form contains a field that is invisible to you and measures the time until you submit. No personal data is evaluated in the process, no cookies are set and no third-party service is involved.

5. How we handle your enquiry

Your enquiry is stored in a database and additionally reaches us by email. In the database we record the processing status and internal notes on your enquiry so that we can look after you reliably. Access is limited to named members of staff with a personal, password-protected account. The legal basis is Art. 6(1)(b) or (f) GDPR.

6. Recipients of your data

To run this website and handle your enquiry we use service providers who process your data exclusively on our instructions (processing on behalf of a controller under Art. 28 GDPR):

  • Vercel Inc., 440 N Barranca Avenue #4133, Covina, CA 91723, USA — operating the website.
  • Supabase Pte. Ltd., 65 Chulia Street #38-02/03, OCBC Centre, Singapore 049513 — the database holding your enquiry. The data is held in a data centre in Frankfurt am Main, Germany.
  • Plus Five Five, Inc. (“Resend”), 2261 Market Street #5039, San Francisco, CA 94114, USA — sending us the notification about your enquiry.

A data processing agreement under Art. 28 GDPR is in place with all three providers; in each case it forms part of their terms of service. Where data reaches a third country in the process, this is based on the European Commission’s standard contractual clauses (Art. 46(2)(c) GDPR), which form part of those agreements.

Beyond this we do not pass your data on, in particular not to third parties for advertising purposes.

7. How long we keep your data

Enquiries that do not lead to an order are deleted automatically 24 months after the last contact. Every reply, from us or from you, restarts that period. If your enquiry leads to an order, we keep the records for as long as commercial and tax law require.

At the latest ten years after the end of the financial year in which the order was placed, we delete these records as well. Ten years is the longest period that commercial and tax law provide for (sec. 257 German Commercial Code, sec. 147 German Fiscal Code).

8. Cookies and analytics

This website currently uses no analytics or marketing services and stores no cookies that require consent. The only thing stored is your choice of language, in the cookie “sprache” (value de or en, lifetime one year), so that later visits appear directly in that language. This cookie is required for the display you asked for (sec. 25(2) no. 2 TDDDG) and contains no data that identifies you.

9. Your rights

You have the right to information (Art. 15 GDPR), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and objection (Art. 21). You can withdraw any consent you have given at any time with effect for the future. You can also lodge a complaint with a data protection supervisory authority (Art. 77 GDPR).
